Platform Terms of Service

1. Introduction
These Terms of Service (the "Agreement") govern your use of the Plain Harmony platform ("Platform"), which is operated and managed by MD79 Inc. ("Company," "we," "us," or "our"). By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with any provision of this Agreement, you must not use or access the Platform. This Agreement constitutes a legally binding contract between you and the Company and governs your access to and use of the Platform, its features, content, and services. It is your responsibility to read and understand this Agreement in its entirety. We may update, modify, or revise these Terms at any time, and such changes will become effective upon posting on the Platform. You are advised to review these Terms periodically to ensure that you remain in compliance. Your continued use of the Platform after any updates or changes to these Terms will constitute your acceptance of those changes. In addition to these Terms, you may also be subject to other policies, guidelines, or terms and conditions that may apply to specific features, products, or services available through the Platform. These additional policies are incorporated into this Agreement by reference and you agree to comply with them as well. By accepting these Terms, you affirm that you have the legal capacity to enter into this Agreement. If you are accessing or using the Platform on behalf of an organization or other entity, you represent and warrant that you have the authority to bind such organization or entity to these Terms, and any references to "you" in these Terms will refer to such organization or entity.
2. Account Registration and Responsibilities
To access and use the services provided by the Platform, you must first create an account. By registering for an account, you agree to provide accurate, current, and complete information about yourself as required by the registration process. You also agree to promptly update any information that may become inaccurate or outdated. The Company relies on the information provided by you to manage and administer the Platform’s services, and it is your responsibility to ensure the accuracy of your account details. If you provide any information that is inaccurate, incomplete, or false, the Company reserves the right to suspend or terminate your account, and to deny any future use of the Platform. Your account allows you to access various features and functionalities of the Platform. It is your responsibility to maintain the confidentiality of your account credentials, including your username and password, and to control access to your account. You are solely responsible for all activities that occur under your account, whether authorized or unauthorized. You agree to immediately notify the Company of any unauthorized use or breach of security of your account. You agree to use the Platform for lawful purposes and in accordance with the Terms of Service. If you engage in any activity that is prohibited under these Terms or that may harm the Platform, its users, or the Company, we reserve the right to suspend or terminate your access to the Platform without notice.
- Account Creation: During the registration process, you will be required to provide certain personal information, including but not limited to your name, email address, and payment details. You represent and warrant that all registration information you provide is accurate, complete, and up-to-date. You also agree to maintain and update this information as necessary to keep it accurate, current, and complete. The Company is not responsible for any issues, damages, or disputes arising from inaccurate or incomplete registration information provided by you. When registering, you will be prompted to create a username and password, which will be used to access your account. You agree to keep your login credentials confidential and not to share them with any third party. You are solely responsible for maintaining the confidentiality of your login information and for all activities that occur under your account. In the event that you suspect unauthorized access to your account, you must immediately notify the Company to take appropriate action to secure your account. You agree that the Company may use the information you provide to process your registration and provide services related to your account. This may include sending you service-related communications, such as updates on your subscription, notifications regarding platform changes, and promotional offers.
- Eligibility: To create an account and use the Platform, you must be at least 18 years of age or older. By registering for an account, you affirm that you meet this eligibility requirement. If you are under the age of 18, you must have the permission of a parent or legal guardian to use the Platform. In addition, you must have the legal capacity to enter into a contract and be bound by the terms of this Agreement. If you are registering on behalf of a business or entity, you represent and warrant that you have the authority to bind such business or entity to the terms and conditions of this Agreement. If you do not meet these eligibility requirements, you are prohibited from using the Platform, and any use of the Platform by individuals who do not meet the criteria will be considered unauthorized. The Company reserves the right to verify your age or eligibility at any time and to terminate your access if it is determined that you do not meet the required criteria. We may, at our sole discretion, refuse to allow individuals or entities to register for the Platform. We reserve the right to suspend or terminate any account that we believe does not meet these eligibility criteria or violates the spirit of this Agreement.
- Account Security: You are responsible for maintaining the security and confidentiality of your account, including your username, password, and any other personal identification details associated with your account. You agree to notify the Company immediately of any unauthorized access to or use of your account. The Company will not be responsible for any losses or damages resulting from your failure to protect your account information or from any unauthorized access to your account. As a part of the security measures, you agree to take reasonable precautions to safeguard your account credentials. This includes using a strong and unique password for your account and not sharing your credentials with others. You are solely responsible for the actions that occur under your account, whether or not you have authorized those actions. If you believe that your account has been compromised, you must contact us immediately to help secure your account. The Company employs security measures to protect the platform and its data, but you acknowledge that no method of transmitting data over the internet or of electronic storage is completely secure. Therefore, the Company cannot guarantee the absolute security of your account and personal information. You accept the inherent risks associated with using the internet and the platform, and you agree to take appropriate measures to protect your information and ensure your account’s security.
3. Privacy and Data Practices
At Plain Harmony, we place great importance on protecting your privacy. We are fully committed to safeguarding the confidentiality and security of your personal data. By using our Platform, you entrust us with sensitive information, and we take this responsibility seriously. We understand that your personal data is private, and we adopt stringent measures to ensure that it is handled securely and transparently. Our practices are designed not only to comply with applicable privacy laws but also to maintain your trust as we continue to offer and enhance our services.
- Data Collection: As part of your use of the Plain Harmony Platform, we may collect personal data that is essential for delivering the services you request and ensuring your experience is seamless. This information can include, but is not limited to, your name, email address, billing and payment details, and logs of your usage patterns while interacting with our services. We collect this data when you register for an account, access specific services, communicate with our support team, or engage with promotional materials. The data we collect enables us to personalize and improve your experience on the Platform, tailor our offerings, and respond to your needs more effectively. Additionally, we may gather information about your device and browser settings to optimize the Platform's performance and compatibility. We prioritize your right to privacy and ensure that any data we collect is used only for the stated purposes outlined in our Privacy Policy.
- Data Usage: The personal data we collect serves several key purposes. Primarily, it allows us to deliver and improve our services, ensuring that you have the best possible experience with Plain Harmony. We use your information to communicate with you about your account, including updates on services, payments, renewals, and promotions. Additionally, we rely on this data to comply with legal and regulatory requirements, process transactions, and protect the Platform’s security and integrity. Your data also helps us maintain the performance and functionality of the Platform by allowing us to identify issues or areas for improvement. Furthermore, by analyzing how you interact with the Platform, we can refine our user experience, offer new features, and tailor the content to your preferences. While we may share aggregated data for analytical purposes, all personally identifiable information is handled with the utmost care, ensuring that we only use it in ways that align with your expectations and our contractual obligations.
- Third-Party Sharing: We take the privacy of your personal data very seriously and do not engage in the sale or trade of your personal information. However, there are instances where we may share your data with third parties, but only under strict conditions. We may disclose your personal data to trusted service providers who assist us in operating the Platform, fulfilling services, processing payments, or enhancing user experience. These service providers are required to adhere to confidentiality agreements and are only permitted to use your data for the purpose of providing the agreed-upon services. 4. Payments and Billing
Plain Harmony operates as a subscription-based service, and as such, your use of the Platform requires a valid subscription to access the full suite of features. By subscribing, you agree to the terms and conditions outlined in this section, which governs the pricing, payment structure, billing cycles, and refund policy associated with your subscription. This subscription model allows for a seamless and uninterrupted service experience as you access various functionalities. The details of the service plan, including payment intervals, are communicated to you clearly during the purchase process. It is important to note that the subscription model provides you with continuous access to the Platform’s services, and you will be billed automatically at the start of each billing cycle unless you choose to modify or cancel your subscription according to the policies outlined herein.
- Subscription Fees: As part of your agreement with Plain Harmony, you agree to pay the subscription fees associated with the selected service plan. The applicable fees will be clearly outlined at the time of purchase or renewal and will reflect the features and services you wish to access. These fees are subject to periodic review, and while we will make every effort to notify you in advance, prices may be adjusted to reflect changes in service offerings, inflation, or other factors. If any changes to the pricing occur, we will inform you through email or via notifications within your account dashboard, giving you an opportunity to review the new fees before they take effect. All fees are payable in advance for the chosen subscription period, and payment must be received before the services are activated. Failure to pay any applicable fees may result in a temporary suspension or termination of your account until the balance is cleared.
- Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you take action to cancel it beforehand. This auto-renewal process is designed to ensure that you experience uninterrupted access to the Platform without the need to manually renew your subscription. At the end of each billing cycle, the applicable subscription fee will be charged to the payment method you have provided, and your account will be automatically renewed for another cycle unless you opt-out. You will receive an email reminder prior to your renewal date, informing you of the upcoming charge. If you wish to prevent the auto-renewal, you must cancel your subscription before the renewal date. Once canceled, your access to the Platform will continue until the end of your current billing cycle, and no further charges will be made for subsequent periods.
- Cancellation Policy: You have the right to cancel your subscription at any time via your user dashboard. Upon cancellation, you will retain access to the Platform’s services until the end of your current billing period, after which your account will no longer be billed for the next cycle. It is important to note that no refunds will be issued for any unused portions of your subscription unless required by applicable law. If a refund is mandated by law, it will be processed according to the relevant legal requirements. In the event of a cancellation, you will not be charged for any subsequent billing periods, and your access to the Platform will be revoked once the current cycle concludes. We encourage you to review the terms before proceeding with the cancellation to understand the implications fully. Furthermore, if your cancellation is due to dissatisfaction with the service, you are welcome to contact customer support, who may offer assistance in resolving the issue.
5. Account Termination
We reserve the right to terminate accounts under certain conditions, as detailed in this section. Termination of an account is a serious matter, and it may occur as a result of violations of our terms, failure to comply with applicable laws, or actions that compromise the integrity, security, or functionality of the Platform. This provision ensures that we maintain a safe, fair, and legally compliant environment for all users. Termination may be initiated by either the user or Plain Harmony, and each scenario has specific rules and consequences attached to it. It is essential that you understand the circumstances under which account termination may occur and the resulting effects, including the potential loss of access to services and the handling of your data.
- Termination by User: As a user of the Platform, you have the right to close or deactivate your account at any time, provided you follow the proper procedures outlined within the Platform. You may request account termination by contacting customer support, or by utilizing the account settings section of the Platform, where you will find options to deactivate or delete your account. Please note that after termination, you will lose access to all services and features associated with your account, and you may not be able to recover any data or content stored on the Platform. It is important to recognize that terminating your account does not relieve you from any outstanding financial obligations that may remain, including unpaid subscription fees or other charges. If there are any unresolved payments or breaches of agreement at the time of termination, you may still be held accountable, and your access to the Platform may remain suspended until the issue is resolved.
- Termination by Plain Harmony: Plain Harmony reserves the right to suspend or terminate your account at our discretion, if we determine that you have violated these Terms of Service, applicable laws, or any other agreement that governs your use of the Platform. Violations may include, but are not limited to, engaging in fraudulent activities, abusive behavior, misuse of services, or violating intellectual property rights. In cases where the integrity or security of the Platform is at risk, we may act immediately to suspend or permanently terminate your account, either temporarily or indefinitely. We may also suspend or terminate accounts in the event of non-payment or failure to comply with the subscription billing terms. In the case of serious breaches, Plain Harmony may also pursue legal action to protect its rights, the rights of other users, and the overall security of the Platform. We will notify you of the termination and the reason for such action through the contact details associated with your account.
- Consequences of Termination: Upon termination, whether initiated by you or Plain Harmony, your access to all Platform services will be revoked immediately. This includes, but is not limited to, the cessation of your ability to use features such as course access, communication tools, and content management. All content and data associated with your account may be deleted or rendered inaccessible after a reasonable retention period, in accordance with applicable data retention policies. You understand that following termination, it may not be possible to recover your data, and any data stored on the Platform may be permanently erased or anonymized. Plain Harmony is not responsible for any loss of content, data, or business-related materials due to account termination. If any fees remain due at the time of termination, they must be paid in full. Termination does not affect any legal rights or obligations accrued prior to the termination date, including ongoing legal proceedings or contractual obligations between you and Plain Harmony.
Anti-Spam Policy
6. Overview
At Plain Harmony, we are committed to maintaining a trustworthy and respectful communication environment for all our users. To achieve this, we enforce a strict zero-tolerance spam policy. The sending of unsolicited emails, including promotional or transactional communications, is prohibited. We hold our users to high standards of compliance and accountability. You are only permitted to send emails through the Platform to recipients who have explicitly opted in, meaning they have actively agreed to receive communications from you. Any attempts to bypass this policy by sending unsolicited messages or using deceptive practices to collect email addresses will be met with severe consequences, including account suspension or termination. This policy ensures that both you and your recipients are protected from unwanted intrusions and preserves the integrity of the Platform.
- Opt-In Requirement: Plain Harmony’s anti-spam policy mandates that all recipients of your communications must provide explicit and verifiable consent before receiving any form of marketing or transactional email. This opt-in process must be clearly documented, and the recipient must have the option to easily confirm their consent, typically through a double opt-in process. It is important to note that consent cannot be inferred from pre-existing relationships, and users must voluntarily engage with the communication opt-in process. The verification of consent should be clear and transparent, meaning recipients must clearly understand what they are agreeing to receive. In the case of any dispute regarding consent, it is your responsibility to provide the necessary evidence to demonstrate that the recipient opted in voluntarily. Failure to comply with this requirement will result in immediate consequences, including but not limited to account suspension or permanent termination of access to the Platform.
- Unsubscribe Mechanism: To further protect recipients, Plain Harmony requires that every marketing or transactional email you send must include a clearly visible and functional mechanism to opt out of future communications. This unsubscribe link or button should be easy to find and use, ensuring that recipients can quickly and easily remove themselves from your mailing list without unnecessary steps. Once a recipient opts out, you are legally obligated to honor this request promptly. The unsubscribe process must be effective, meaning that recipients should stop receiving emails within a reasonable time frame, usually within 10 business days. If the opt-out mechanism is not functioning or is deliberately made difficult to access, this will be considered a violation of our policy, and your account may be subject to suspension or termination. We reserve the right to monitor and audit opt-out mechanisms to ensure compliance.
- Complaint Handling: We take all complaints related to spam seriously. If a user violates this policy, we will conduct a thorough investigation to assess the situation. This investigation includes reviewing the nature of the complaint, the actions that led to the complaint, and any other relevant factors. If we determine that a user has misused the Platform to send unsolicited emails or engage in other spam-related activities, we may suspend or permanently terminate the offending account. Additionally, if necessary, we will report the violation to relevant authorities or take legal action. We encourage users to report any suspected spam activity so we can take the necessary steps to protect the Platform and its users from malicious behavior. Users who repeatedly fail to comply with this policy may be permanently banned from using the Platform. Our goal is to foster a safe, professional, and legally compliant environment for all users.
Acceptable Use Policy

The primary goal of this Acceptable Use Policy is to ensure that all users of the Platform maintain a fair, lawful, and respectful environment. To facilitate this, we ask that all users of Plain Harmony adhere to the guidelines outlined in this policy. The Platform is designed to provide users with the necessary tools to succeed in their respective endeavors, but it is essential that it is not used for any malicious, harmful, or unlawful purposes. This policy is meant to protect both individual users and the broader community from harmful activities that could result in legal consequences, reputational harm, or the disruption of services. Any violation of these terms may result in suspension or termination of your access to the Platform.
- Illegal Activities: Plain Harmony strictly prohibits the use of its platform to engage in any form of illegal activities. This includes, but is not limited to, the promotion of fraud, human trafficking, or the distribution of illegal content. It is your responsibility to ensure that any activities you engage in on the Platform comply with all applicable laws, including local, national, and international regulations. Any use of the Platform to conduct unlawful activities will result in immediate suspension or termination of your account, and may also result in legal action being taken against you. Activities such as the sale or distribution of counterfeit goods, engaging in intellectual property theft, or using the platform for illicit financial activities like money laundering are also prohibited. We take these matters very seriously and will work with relevant authorities to report any illegal behavior that comes to our attention. Users involved in such activities will be held accountable for their actions under the full extent of the law.
- Harmful or Abusive Behavior: The Platform is intended to foster a safe, respectful, and professional environment. You must not use the Platform to engage in any form of harmful, abusive, or discriminatory behavior. Harassment, threats, intimidation, or exploitation of any kind will not be tolerated under any circumstances. This includes the use of the Platform to promote hate speech, engage in defamation, or encourage violence against individuals or groups. Additionally, any form of sexual harassment, bullying, or offensive language directed at other users is strictly prohibited. Users are expected to respect each other’s rights and dignity while interacting on the Platform. Any violation of this policy can result in the suspension of your account, and in cases of severe misconduct, a permanent ban from the Platform. - Security Violations: Ensuring the security and integrity of the Platform is a top priority. You are prohibited from attempting to bypass any of the security measures in place to protect the Platform, its users, and its data. This includes attempting unauthorized access to system networks, scanning for vulnerabilities, exploiting security weaknesses, or gaining access to data without proper authorization. You must not engage in activities such as distributing malware, viruses, spyware, or any other form of malicious software designed to harm or interfere with the functioning of the Platform or its users. Any attempt to interfere with the normal operation of the Platform, whether through denial-of-service attacks, hacking, or other disruptive tactics, is strictly prohibited and will result in immediate suspension or termination of your account. Violations related to security will be investigated thoroughly, and any breaches may lead to the involvement of legal authorities to address the issue under applicable laws.
- Content Responsibility: You are solely responsible for the content you upload, share, or publish through the Platform. This includes any text, images, videos, audio, or other forms of content. You must ensure that all content complies with applicable laws and does not infringe on the intellectual property rights of others. Posting or sharing content that violates privacy rights, promotes harmful or misleading information, or impersonates others is strictly prohibited. We expect you to use the Platform responsibly by ensuring that the content you post does not harm, defame, or harass others in any way. Additionally, the content you upload must not be discriminatory or violate the Platform’s terms of service. You agree to indemnify and hold Plain Harmony harmless for any claims, damages, or legal issues that arise from your use of the Platform and any content you submit. We reserve the right to remove any content that we believe violates these guidelines and to suspend or terminate accounts responsible for such content.
